FACULTY ASSOCIATION GRIEVANCE OFFICER
The Faculty Association (FA) is the exclusive bargaining agent for all faculty in the Foothill-De Anza Community College District. The FHDACCD-FA Agreement is the collective bargaining agreement between the Association and the District. Its current term of effect is July 1, 2004 through June 30, 2007. All District faculty should have a current copy of the Agreement. Contact Office Manager Susanne Elwell (see below) to obtain a copy. Article 5 of the Agreement defines the Grievance Process, the steps that the FA and the District use to resolve contractual disputes between the parties. In brief, a grievance is a written allegation by either a faculty member or the Association that the District has violated, missapplied or misinterpreted one or more provisions of the Agreement. The process used to resolve such grievances consists of three phases: Conciliation, Internal Review and Arbitration. Each phase has its own timelines and provisions. Each campus has a conciliator who has been trained by the FA to consult with faculty regarding potential grievances. The campus conciliators are contract experts who help faculty assess and resolve contractual grievances, or refer faculty to appropriate resources if the Agreement does not have jurisdiction. The campus conciliators assist faculty during the Conciliation phase; the Grievance Officer (currently Tom Strand) assists faculty during the Internal Review and Aribtration phases.
