ASFC Online Voting
Election Code
Article I-Name
- The name of the board established herein shall be the ASFC Elections Board, and this document shall be known as the ASFC Elections Code.
Article II Purpose and Responsibility
Section 2.01 Purpose
- The purpose of this Board shall be to develop for the approval of the ASFC Campus Council, and Thereafter to implement appropriate rules and regulations for conducting all elections, referendums, and other actions requiring a vote by the general membership of ASFC.
Section 2.02 Responsibility
- The ASFC Elections Commissioner shall be responsible for conducting all elections, referendums, and other actions requiring a vote by the general membership of ASFC. Members of the ASFC Elections Board shall assume all duties and responsibilities as defined elsewhere herein as well as those which may devolve upon the Board.
Article III Membership
Section 3.01
- The ASFC Elections Board shall consist of five ASFC members and an advisor: The ASFC Elections Commissioner, Vice president of Administration, Vice President of Activities, two members-at-large of the ASFC (to be appointed by the Election Commissioner and approved by the Campus Council) and the Associate Dean of Students or his/her designee who shall be the advisor without voting privileges.
Section 3.02
- If any member of the Board shall be candidate in an election endorse a candidate. Be a plaintiff in a challenge, or otherwise become ineligible to serve on the Board. The ASFC Elections Commissioner shall appoint with the approval of Campus Council. A replacement to serve for that election or for a specific challenge.
Article IV Officers
- The officers of this Board shall be a Chair, who shall be the ASFC Election Commissioner, and a Vice Chair and Secretary to be selected by the Board from its membership. In the absence of the Chair, the Vice chair shall preside over the meetings.
Article V Meeting Schedule
- Regular or special meetings of this Board shall be called by the Chair or his/her representative.
Article VI Quorum
- Three members, including the Chair shall constitute a quorum for official meetings.
Article VII Standing Rules
Section 7.01 Election of Officers

| 100-01 |
Election shall be held four (4) weeks prior to the end of the quarter in which elections are held, unless stipulated otherwise herein or in the By-Laws of the ASFC Constitution. |

By the third regular meeting of the ASFC Campus Council in quarter in which elections are required by the ASFC By-Laws, an election schedule shall be submitted in writing by the Election Board to the Council for its adoption. |

The Election schedule shall include the following: |
| 100-03-01 |
- A statement of officers to be elected.

| 100-03-02 |
- A schedule of dates and times indicating the period during which candidate petitions will be received and where petitions are to be submitted.

| 100-03-03 |
- Stipulations as to be the time period and standing rules of the campaigning.
|
| 100-03-04 |
- Voting schedule. Including the date(s) of the election. The polling hours. And the location(s) of the polling places.

- Stipulation of the date and time when the Board will receive. Review, and resolve challenges.

| 100-03-06 |
- The time when election results are to be tallied and when an official report will be made to ASFC Campus Council.

- Stipulation of the date and time when the Elections Commissioner will receive spending reports from candidates.

| 100-04 |
In addition to the Election Schedule, the candidates will at the same time be given a copy of this Elections Code. The ASFC Constitution and By-Laws, and applicable literature about the office they seek. Candidates for President of ASFC will be informed of the general ASFC membership address date. The address is also open to the candidates of other offices. |
Section 2 EC SR 200 Filing by Candidates

ASFC members wishing to become candidates for an ASFC elected office must adhere to all the requirements stipulated in the ASFC Constitution and By-Laws and in the ASFC Election Code. |

Members wishing to run for office must, submit an ASFC Candidate Petition for Elective Office to declare their candidacy to the Elections Board. |
| 200-03 |
Members may only run for one elective office per election. |
| 200-04 |
To be certified eligible for election. Candidates shall: |
| 200-04-01 |
- Meeting all the requirements in the ASFC Constitution and By-Laws for the office they seek.

| 200-04-02 |
- Be certified in "good standing" by the Registrar of Foothill College, according to the current State of California Education Code.
|
| 200-04-03 |
- Have petitions signed by the ASFC Vide President of Administration, Elections Commissioner, and ASFC Campus Council Advisor.

| 200-04-04 |
- Submit petitions to the Elections Board as stipulated in the adopted Elections Schedule.
|
| 200-04-05 |
- If no candidate petition is submitted to the Elections Board by the specified deadline. The Elections Commissioner shall automatically submit a challenge to that person’s candidacy. The charge shall be: Failure to adhere to Election Code 200-03-04. The Elections Commissioner shall be prosecutor of the charge.

Section 3 EC SR 300 Tallying of Votes

The results of all elections shall be tabulated by the Elections Board. It shall be the decision of the Board to include the presence of the ASFC Campus Council Advisor in the tallying of Votes. |
| 300-2 |
The candidate receiving the majority of the votes cast for an office sought in any election shall be declared elected, except in the case of ASFC Senatorial elections. In the election of ASFC Senators, those candidates shall be declared elected, according to the number of Senator seats for election. |
| 300-3 |
In the event no presidential candidate receives a majority of the votes cast for the office, as described above, a run-off election between the two candidates receiving the most votes will be conducted by the Elections Board no later than seven days after the official count of votes. |

The results of the unofficial returns in all elections shall be posted the following day after the official close of voting by the Elections Board.

An official canvas of votes cast and their certification shall be presented to ASFC Campus Council.

Section 4 EC SR 400 Challenges
| 400-01 |
Challenges as to the eligibility of candidates ballots, voting, elections results, and other challenges relevant to the election procedure shall be resolved by the Elections Board with a summary of its findings to be included in the Boar’s official report to Campus Council. |
| 400-02 |
Challenges must be submitted in writing and signed. Each challenge must have a defendant. A charge, and a plaintiff. It is the plaintiff’s responsibility to prosecute the charge before the Elections Board. If no prosecutor appears before the Board at the schedule time and date. The charges will be dropped. |
| 400-03 |
In the event that accusations are brought before the Board regarding any candidate. That candidate had the right to answer their accusations before the Board. |
Section 5 EC SR 500 Campaigning
| 500-1 |
All candidates campaign must adhere to general Foothill College publicity codes and the Election Code. |
| 500-2 |
The Election Board shall determine and announce the period during which campaigns may be conducted. |
| 500-3 |
Candidates may not campaign within 20 feet of the polling booth(s) on election days, no may campaign posters and literature be displayed within 20 feet of the polling booth(s) on election days. |
| 500-4 |
Campaign expenditures by or for any candidate may not exceed two hundred dollars ($200.00). Any form of donation, including donated help and gifts, shall be included in the amount stated above.

The candidates complete and total report of their expenditures shall be reported to the Elections Board as stipulated in the Elections Schedule. |
| 500-6 |
If no financial statement is submitted by a candidate to the Elections Commissioner by the specified deadline, the Elections Commissioner will automatically submit a challenge to the person’s candidacy. The charge shall be: Failure to adhere to the Elections Code 500-06. The Elections Commissioner shall be the prosecutor of the charge. |

During an online election, a polling booth is defined as any electronic device on campus that can be used as a means to cast votes. |
| 500-8 |
Polling booths are the responsibility of Elections Commission and should have no affiliation with any candidate. The use of personal laptops, mobiles, PDAs or other electronic devices belonging to candidates or candidate supporters is prohibited. |

Candidates are expected to follow the ASFC Code of Ethics and Publicity Code in regards to their campaigning and candidacy. Campaigning not specified in the Publicity Code requires additional approval by the Director of Student Activities. Only one posting per location, per candidate shall be permitted. If one posting features more than one candidate, no additional material for any of the featured candidates shall be allowed in that location. The Elections Commission shall be in charge with taking down or disallowing any posting or campaign advertisement provisionally, not in compliance with the Publicity Code, ASFC Constitution, Bylaws & Codes. |
Section 6 EC SRF 600 Postponement of Elections

An ASFC Election may be postponed only the approval of the Campus Council. |
Section 7 EC SR 700 Penalties
| 700-01 |
Refusal of a candidate to comply with properly approved Standing Rules of this Board, the Elections Code, the ASFC By-Laws and Constitution. And the adopted Elections Schedule may result in the disqualification of the candidate as determined by the Elections Board. |
| 700-02 |
Campaigning on behalf of a candidate involving the use of force, fraud or coercion by said candidate or anyone else with the express knowledge of said candidate shall result in the disqualification of the candidate. |

Section 8 EC SR 800 Special Elections
800-01 As may be necessary to effectively conduct special elections for ASFC, this Board shall develop and submit to ASFC Campus Council for Approval. Standing Rules relative to the conduct of a special election as necessary.
Article VII Minutes and Reports
Section 8.01 The Elections Board shall cause to promptly disseminate to its membership and to the ASFC Campus Council its minutes and such reports and other proceedings as it may from time to time receive, adopt, and/or otherwise promulgate.
