Tax Filing Requirements for All International Students for 2007
The United States tax system requires EVERY NONIMMIGRANT present in the U.S. in 2007, whether you worked or not, to file a form with the Internal Revenue Service. This also applies to your spouses and dependents/children on F-2 visas.
If you were not present in the United States in 2007, you dont need to file any forms this year.
Unfortunately, the staff of the International Student Office is NOT ABLE to provide individual tax advice. But our office is working hard to provide students with all the possible resources, such as the new FREE ACCESS to CINTAX, which is a quick and easy way to prepare your federal tax forms online, exclusively for international students.
Please, do not neglect the tax-filing deadlines! When you make an application for an extension or a change of immigration benefits, such as an H-1B visa or a "green card", these tax records will be verified. Don't let a mistake now ruin your future with immigration. File your tax returns as required!
NB! It is very important to determine your residency status for tax purposes before deciding which forms to file and whether you can use CINTAX.

Tax Filing Deadlines
If you worked in 2007, the last day to meet your federal and California state tax obligations is April 15, 2008.
If you did not earn any income in the U.S. in 2007 or for spouses and dependents/children, your deadline for filing a federal Form 8843 is June 15, 2008.
Residency Status for Tax Purposes
The forms that you need to file depend on your status. For federal tax purposes, you must first determine whether you are considered a RESIDENT or a NONRESIDENT alien.
If a student spends more than 5 years in the United States in F-1 status, he/she will be considered a resident alien and must be taxed like a U.S. citizen. Note that any part of a calendar year in which a student is present in the U.S. counts as a full year. If you determine that you are a resident for tax purposes, you will NOT BE ABLE to use CINTAX (see below).
For example, if you have been present in the U.S. in F-1 status since December 2003 (or any part of the year), you are still considered a nonresident for filing your 2007 tax returns. However, if you have been present in the U.S. in F-1 status since 2002, you are considered a resident.
The International Student Office does not offer any assistance for resident tax filing. You should utilize the resources and assistance available elsewhere to US citizens.
NB! Tax residency in no way equals residency for immigration purposes.
What Forms You Should File
If you are considered a resident (read above) for tax purposes and you worked in 2007:
If you are considered a nonresident for tax purposes and you worked and received a salary/wages in 2007:
If you are considered a nonresident for tax purposes and you did NOT work or receive a salary in 2007: but were present in the United States (also applicable to dependents) Form 8843 is the only form you should file.

Employer Documents: W-2 and/or 1042-S
In order to fill out your federal and state tax forms (by hand or when you are using CINTAX), you will need the following forms depending on the income you receive: W-2 and/or 1042-S.
For those that worked in the U.S. in 2007, a W-2 form (Wage and Tax Statement) should have been mailed out to you by January 31 of this year. If you are a student and worked on-campus in 2007, please be aware that you will receive a W-2 Form in the mail. You will need to attach one part of the W-2 to your federal tax return, one part to your state tax return and one part will be kept for your records.
If you worked in 2007 and do not receive a W-2 and/or 1042-S by the middle of February, you should contact your employer's payroll department. MAKE SURE THAT YOUR EMPLOYER KNOWS YOUR NEW ADDRESS IF YOU RECENTLY MOVED.

Individual Taxpayer Identification Number (ITIN)
The ITIN number is needed ONLY for those people WITHOUT a Social Security Number who are eligible to be claimed as dependents on a U.S. income tax return.
Only nonresident aliens from a very limited number of countries may claim an exemption for their dependents on their U.S. income tax return (Form 1040NR).
CINTAX will take care of the ITIN requirement (if you need one) and prepare an appropriate form when you are using the software.
Please note that if you are not required to file an income tax return (Form 1040NR or Form 1040NR-EZ), but are required to file Form 8843, you do not need to apply for a social security number (SSN) or an individual taxpayer identification number (ITIN).
